ORDINANCE # 2025 – 07

AMENDMENTS TO THE GENERAL CODE OF ORDINANCES CHAPTER 58 – UTILITIES, ARTICLE 4 – SEWER SERVICE

Notice is hereby given that the Dexter City Council adopted the following General Code of Ordinances Amendment at a Regular Meeting on the 22nd day of September, 2025, which was called to order by Mayor Keough at 7:00 PM Eastern Time.

PRESENT: Aldag, Hubbard, Popov, Semifero, Tell, Keough

ABSENT:  Schlaff

The following ordinance amendment was offered by Member Aldag and supported by Member Tell.

The City of Dexter City Council hereby ordains, Chapter 58 of the Code of Ordinances, City of Dexter, Washtenaw County, Michigan, is hereby amended as follows:

SECTION 1:  The City of Dexter General Code of Ordinances, Chapter 58, Article 4 – Sewer Service is amended in accordance with the changes as presented to City Council on September 22, 2025. The changes include, but are not limited to, the following:

  • Added, updated, deleted, and reorganized definitions.
  • Standardized use of terms throughout the Ordinance based on definitions.
  • Reorganized, moved, and combined sections for clarity.
  • Added new section regarding projects impacting utility infrastructure.
  • Clarified that each building is required to have its own sewer lead.
  • Updated connection distance to 200’ from main per State law.
  • Expanded “Use of Public Sewers Required” section with similar language from the Water Ordinance’s “Connection Required” Section. Added that disconnection is not permitted except under specific circumstances.
  • Addressed vacant and disconnected structures.
  • Identifies that those that have vacant disconnected structures may reconnect within five years to avoid penalty. If they do not reconnect and have not been paying ready-to-serve fees, then they will be considered to be disconnected and will need to pay a new tap fee to reconnect.
  • Standardized the billing and collection language.
  • Identified billing exemption for high water use where water does not go into the sewer.
  • Updated materials and surcharge limits per MAHL.
  • Added explanation of how industrial user capital recovery charges will be applied in Section 58-129. This section would be used to charge users who use more capacity than they have been allocated due to the strength of their waste stream.
  • Added section relating requirements for grease traps and grease interceptors for fats, oils, and grease (FOG).

The full text has been omitted from this notice due to its length, but it is available for review at City Hall, 3515 Broad St, Dexter, MI 48130 from 9:00 AM to 5:00 PM on business days and on the City’s website at www.dextermi.gov.

SECTION 2: Effective Date: This Ordinance shall become effective upon publication, in accordance with the City Charter.

SECTION 3: Consistency and Repeal: All existing Ordinances or part of Ordinances are to be interpreted as consistent with this Ordinance and State Law. Any Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance are hereby repealed.

SECTION 4:  Geographic area: This Ordinance shall have effect in all geographic areas of the City of Dexter to the fullest extent allowed by law.
